MEMORANDUM OPINION
THOMAS F. HOGAN, District Judge.
Pending before the Court are three motions: plaintiffs’ motion for summary judgment on Counts One and Three of the Amended Complaint, plaintiffs’ motion for a preliminary injunction, and defendants’ motion to dismiss the entire Amended Complaint. The Court held a hearing on these motions on March 17, 1998. After consideration of the parties’ briefs and arguments at that hearing, the Court will grant plaintiffs’ motion for summary judgment on Count One; at this time, however, the Court will grant judgment only on the issue of liability, and…
