Proceedings by foreign attachment were unknown at the common law. In this State the proceeding is commenced by the filing by the plaintiff of an affidavit and suing out thereon the process which is known as the writ of foreign attachment. “The purpose of the process * * * is to acquire jurisdiction of a defendant who does not reside within the jurisdiction of the court, by taking his property within the jurisdiction and thereby compelling his appearance to the suit of his creditor.” Woolley on Del.
