ERROR TO THE SUPREME COURT OF THE STATE OF DELAWARE. The case is stated in the opinion, post, 98. The statutes of Delaware and the. proceedings taken thereunder in this case are unconstitutional and void, in that plaintiff in error was thereby deprived of his property without due process of law. The essential elements of due process, namely, the right to appear and to be heard in defense of the action in which plaintiff in error’s property was attached, are lacking here.

This writ of error brings under review a judgment of the Supreme Court of the State of Delaware affirming a judgment of the Superior Court in a proceeding brought by defendants in error by foreign attachment against the property of plaintiff in error pursuant to the statutes of that State.
