GRAVEN, District Judge.
In this action the plaintiff, a landowner, seeks to recover damages from the defendant growing out of the defendant’s actions in connection with its pipeline easement across his land. The plaintiff is a citizen of the state of Iowa. The defendant, hereafter referred to as the company, is a corporation organized and existing under the laws of the state of Delaware engaged in the distribution of gas.
