On the 29th day of June, 1929, the plaintiff was an employee of the Gridley Dairy Company, in the city of Milwaukee. About 1:30 a. m. of that day he was delivering milk to the patrons of the company on the Blue Mound highway in said city. His milk wagon was proceeding east on the south side of the highway and in close proximity to the curb. A tourist going west on the Blue Mound highway brought his car to a stop on the north side thereof and crossed the street to the milk wagon to make inquiries of the plaintiff.
