Statement.

MONROE, J.

The petition in this case alleges that on January 5, 1898, the defendant, Bodenheimer, sold to the plaintiff, with warranty of title and with subrogation of warranty against the People’s Bank, “a certain sugar plantation known as ‘Coteau Plantation,’ in the parish of St. Mary,” declared in the act of sale to consist of certain described tracts of land, and that said plantation had upon the same day been acquired by the vendor from the People’s Bank, by means of an act of sale containing the same description; that in both of said acts certain of the lands intended to be…
