MORRIS, Judge.

This is an action by the plaintiff to recover for damage to his automobile and personal injuries sustained by him in a collision of an automobile owned by the plaintiff in which he was riding and driven by his wife with one owned by the defendant Omar Erb and driven with his permission by the defendant Paul Erb on a public highway in the State of Minnesota on November 26, 1953.
