MEMORANDUM & ORDER

BRIEANT, District Judge.

By Petition filed on March 13, 2001, two incorporated municipalities, the Town of Amenia, New York and the Town of Sharon, Connecticut (“Petitioners”) petition this Court pursuant to Rule 27 Fed.R.Civ.P. for an Order permitting them to take the deposition of a prospective witness, Mr. Earl Sel-fridge, in order to perpetuate his testimony. Curtiss-Wright Corporation, a potential adverse party in foreseeable federal litigation described below, filed Opposition papers to this Petition on March 19, 2001.
