FUTEY, Judge.
This Fair Labor Standards Act class action is before the Court on the parties’ cross-motions for summary judgment on the issue of liability. Plaintiffs, who are Federal Air Marshals (“FAM”), allege that defendant failed to pay them overtime compensation for hours they worked in excess of forty hours per week, in violation of section 207(a)(1) of the Fair Labor Standards Act of 1938 (“FLSA”), 29 U.S.C. §§ 201-219 (2008).
