Appellee filed its complaint in the court below, alleging, in substance, that it is an electric railroad *305company and a corporation organized under the laws of the State of Indiana, having the right to exercise the power of eminent domain for public use under the statutes of the State, and desires to exercise such power; that defendant Mary A. Slider is the owner of the land hereinafter described, which plaintiff desires to condemn,- and that Henry Slider is her husband; that the right of way and track of plaintiff crosses the highway which joins the Sellersburg and Memphis…
