Spencer, J.:

In a suit for damages for personal injuries, the jury returned its verdict in favor of defendant and plaintiff has appealed.

On September 28, 1971, plaintiff was selling and delivering newspapers to patients and employees in defendant hospital. Plaintiff was in the front lobby of the hospital with a bag of tightly packed newspapers resting on her left shoulder when Danny Rome, who was employed by defendant as a janitor, approached her from behind and attempted to remove a newspaper from the bag.
