This is an employment discrimination case brought under the Americans with Disabilities Act, 42 U.S.C. § 12101 et seq. (the Act or the ADA), and the Kansas Act Against Discrimination, K.S.A. § 44-1001 et seq. The plaintiff also alleged fraud and breach of implied contract. The district court granted defendant summary judgment on the fraud claim prior to trial. At the close of plaintiffs evidence, the district court granted defendant’s motion for judgment as a matter of law on the breach of implied contract claim, a ruling which has not been challenged on appeal.
