-This is an appeal from a judgment in favor of Yernor M. Watson and Gladys Watson, his wife, hereinafter called plaintiffs, against J. R. McFadden, as Sheriff of Maricopa County, hereinafter called defendant, for the possession of a certain automobile levied upon by defendant in his official capacity, under an execution.

In order that the issue before us may be properly understood, it is necessary that we review briefly the facts not only of the present but of another action. These facts are not in serious dispute, and may be stated in a narrative form as follows:
