MEMORANDUM OPINION
LAMBERTH, District Judge.
This matter comes before the court on remand from the Court of Appeals, Armstrong v. Accrediting Council for Continuing Education and Training, Inc., 84 F.3d 1452 (D.C.Cir.1996) (unpublished table decision), and on defendants’ renewed motions to dismiss plaintiffs remaining claims pursuant to Fed.R.Civ.P. 12(b)(2) and (6). In the alternative, defendants seek summary judgment on these claims.
