In Muratori v. Stiles & Reynolds Brick Co., 128 Conn. 674, 675, 25 A.2d 58 (1942), our Supreme Court construed General Statutes §§ 23-59 1 and 23-65 (b) 2 as vesting exclusive control in a town tree warden over trees located in whole or in part in public roadways. In view of the tree warden’s exclusive control, the cotut held that owners of private, adjoining land are not liable to anyone accidentally injured by a tree falling in the roadway. Id., 677-79.
