[¶ 1.] Patricia M. Paul appeals from an order granting her former husband, Richard Divich, relief from a judgment and decree of divorce. We reverse and remand.
FACTS
[¶ 2.] Patricia and Richard were married in 1960 and divorced in 1988. As part of the divorce proceedings, the parties entered into a stipulation and property settlement agreement later incorporated into the divorce decree. Richard was employed as a teacher in the Rapid City School System and Paragraph VI of the agreement attempted to provide for the division of Richard’s retirement fund administered by the South Dakota Retirement…
