Defendant, Nelson Stephens, was tried and convicted of the offense of hog stealing and given an indeterminate sentence of from one to two years in the penitentiary. He appeals.

In brief, the evidence is as follows: Mary Jane Perkins, a daughter of defendant, testified that defendant killed a hog with a shotgun in the year 1913. The hog weighed about fifty pounds.
