The appellant, Oce Harris, was tried and convicted in the Fulton Circuit Court, under an indictment charging him with the crime of grand larceny, the verdict of the jury fixing his punishment “at hot less than one year and not more than one year and one day in the State penitentiary.” He was refused a new trial and now seeks a reversal of the judgment on the grounds that the circuit court erred: (1) In overruling his motion for a continuance; (2) In refusing, when his case was called for trial, to allow him time to prepare an affidavit showing the…
