THOMAS, Justice.

The appellant submitted in the probate court grounds of contest of decedent’s will.

The probate of the will was in July or August, 1931, and thereafter what is styled a contest was filed in the probate court on October -16, 1931, and no action taken thereon to the date of the motion to strike on December 14,1932. The motion to remove the cause to the circuit court of date of January 6,1933, was passed for hearing to January 21, 1933, was sustained on March 16, 1933, and the contest dismissed.
