This is an action brought by Mrs. Ethel L. Ridgely, daughter of Mrs. Susanna Hape, as administratrix of her late mother’s estate, against the Secretary of the Department of Health, Education and Welfare, in which review is sought of the Department’s denial of certain benefits under Part A of the Medicare Act, 42 U.S.C. § 1395c et seq. Mrs. Hape was transferred to the Foxleigh Nursing Home, an “extended care facility” (ECF) under the terms of the statute, after surgery at the Baltimore County General Hospital for the repair of a fractured hip.
