Embarking upon a new business venture, plaintiff J. H. Goldberg Co., Inc. (Goldberg) undertook the ownership and operation of a furniture and appliance store in the City, of Rochester, Monroe County, New York. On May 15, 1973 Goldberg entered into an employment contract with defendant Malvin S. Stern (Stern) under which Stern was employed as president and general manager for a two-year period at an annual salary of $50,000.
