Convicted of grand larceny in the first degree, defendant Sam Taran appeals from the order denying his motion for a new trial and also from the judgment.
Taran was indicted jointly with one Mark G. Wynn, but had a separate trial. The principal witness against him was Wynn. The indictment charges the two with grand larceny perpetrated by false pretenses. Briefly, the testimony for the state is to the effect that in February, 1927, Taran, by force, actual violence and threats of more, with the assistance of several “gunmen,” made Wynn his prisoner for ten days, and that during that time he…
