The plaintiffs in error, for convenience hereinafter referred to as the defendants, were jointly tried with Buby Herring; were convicted and each of the defendants, Charlie Sands and Leon Siler, found guilty and their punishment assessed at death by electrocution. Motion for new trial was filed, considered, and overruled, and the defendants Sands and Siler appeal.
The record in this case is very voluminous; many pages of the testimony taken over repeated objections and incorporated in the record are wholly immaterial to an opinion in this case, and should not have been gone into by the trial…
