The opinion of the Court of Civil Appeals makes a correct and very comprehensive statement of the facts and issues of this case. In the interest of brevity we refer to and adopt that statement. 49 S. W. (2d) 846. We, however, will here make a sufficient statement to render this opinion complete within itself.
