Defendant Morgan Stanley & Co. Incorporated (“Morgan Stanley”) has moved for judgment on the pleadings, Fed.R.Civ.P. 12(c), and summary judgment, Fed.R.Civ.P. 56, dismissing the First Amended Complaint in its entirety. Morgan Stanley also has moved for default judgment, Fed.R. Civ.P. 55, and summary judgment, Fed.R.
