The parties in this case stand in an order the reverse of that held in the court below. For convenience, we shall refer to the parties as they were in the lower court, calling the Potomac Insurance Company plaintiff and the Ford Motor Company defendant.

The petition sets forth that the plaintiff insured one Ray Middleton, not a party to the lawsuit, against damage to his Lincoln automobile by reason of fire; that Middleton bought said automobile from defendant; that shortly thereafter the paint job on the car developed defects and Middleton thereupon entered into a contract with defendant,…
