This case is before this court on appeal on questions of law from a judgment of the Court of Common Pleas of Lucas county, Ohio, entered upon the verdict of a jury in the sum of $10,000 rendered against the defendant.

The defendant, in its assignment of errors, claims that the court erred upon the trial, as follows:
