MEMORANDUM AND ORDER

GLASSER, Senior District Judge.

The plaintiffs and defendants eBay Inc. and PayPal, Inc., having submitted a revised proposed settlement of this putative class action on March 9, 2007, jointly move pursuant to Federal Rule of Civil Procedure 23(a) (“Rule 23”) and 23(b)(3) for an order certifying the proposed settlement class, pursuant to Rule 23(e) for preliminary approval of the proposed settlement agreement, and pursuant to Rule 23(b)(3) for approval of the proposed plan of notice to class members.1 For *73the reasons stated below, the parties’ motions are denied.
