APPEAL from the Circuit Court for Brown County. Action to recover damages for personal injuries. The defendant is a corporation operating a large iron-smelting furnace at De Pere, Wis. On the 4th of May, 1891, plaintiff was a laborer in defendant’s employ in and about the furnace and yard, and had been such for three years. Defendant uses a large amount of charcoal in its business, which is brought into its yard in railroad cars, and unloaded by its employees into sheds by the side of the railroad track. It is claimed by the plaintiff that this is a case where the evidence tends to show that the master has failed to furnish to his employees a safe appliance. Defendant claims that the selection of the plank was a detail of the employees’ work, and that the selection of a defective plank, if negligence at all, is that of a co-employee and not of the master.
