This matter is before the Court on a motion filed by-defendants, Postmaster General Patrick R. Donahoe and the United States Postal Service (collectively “Defendants” or the “Postal Service”), to dismiss the First Amended Complaint filed by-plaintiff Pat H. O’Neal (“Plaintiff’) for lack of subject-matter jurisdiction pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure, and for failing to state a claim upon which relief can be granted pursuant to Rule 12(b)(6).
