The United States of America (“Plaintiff”) (Doc. # 88) and Montana Refining Company (“Defendant”) (Doe. # 90) have renewed their motions for summary judgment in this action brought under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, 42 U.S.C. § 9601-9675 (“CERCLA”). Because we find that there exist several genuine issues of material fact regarding liability, and that no reasonable jury could find for Defendant as to all other material facts bearing on liability, we DENY Defendant’s renewed summary judgment motion…
