Three Philadelphia hospitals — Hospital of University of Pennsylvania, Presbyterian Medical Center, and Pennsylvania Hospital (collectively, “plaintiffs”) — have filed suit against the Secretary of the U.S. Department of Health and Human Services (“the Secretary”). Plaintiffs seek judicial review of the Secretary’s decision to deny them certain supplemental medical education payments authorized by the Balanced Budget Act of 1997 (“BBA '97”), Pub. L.
