W. O. MURRAY, Chief Justice.

Appellant, Richard B. Collins, instituted' this proceeding for a writ of mandamus to, require appellees herein to grant him a pension as a San Antonio policeman under the provisions of Article 6243f, Vernon’s. Ann.Civ.Stats.

The trial began to a jury, but at the close of the evidence the trial court instructed a verdict in favor of appellees and rendered judgment that appellant take nothing other than the sum of $327.75, deposited by appellant in the registry of the court, which represented the total amount paid by appellant into the Pension Fund since June 1, 1951.…
