DECISION AND ORDER
RICHARD L. SPEER, Bankruptcy Judge.
This matter comes before the Court upon the Plaintiffs Complaint for Damages. After filing a timely Answer to the Complaint, the Defendant filed a Motion for Summary Judgment as well as a Motion for Judgment on the Pleadings. The Plaintiff did not respond to either motion. For the reasons set forth herein, the Defendant’s Motion for Summary Judgment will be Granted.
