We granted the defendant-appellant-petitioner Arthur Corla Locquiao’s application for a writ of certiorari in order to review the *198published opinion of the Intermediate Court of Appeals (ICA) in State v. Locquiao, 100 Haw. 314, 59 P.3d 949 (App.2002) [hereinafter, “the ICA’s opinion”].
