O'Neal v. Bush & Tillar

Error to the Court of Civil Appeals for the Sixth District, in an appeal from Tarrant County. E. V. O’ETeal and others sued Bush & Tillar, and obtained judgment for $29,095.68. Defendants appealed and the judgment was reversed and rendered in favor of appellants. Appellees thereupon obtained writ of error.

We copy the following statement of facts from the opinion of the Court of Civil Appeals:

“Appellants owned about 50,000 acres of land in Scurry and other counties, which they contracted to sell to appellees. The contract was entered into on October 27, 1906, and was evidenced by a writing of that date. The price to be paid by appellees for the land was $6.50 per acre. They paid $10,000 on the purchase price at the time the contract was executed.
