Cross appeals in an action brought to recover damages on account of the fatal burning of plaintiff’s intestate, his daughter, aged three and one-half years, her clothing having caught fire from a fire set upon defendant’s right of way for the purpose of consuming the withered grass and other rubbish which had accumulated thereon.
