MEMORANDUM OPINION AND ORDER

Before the Court is a Motion for Judgment on the Pleadings (the “Motion”) brought by defendants Vista Controls, Inc. and Curtiss-Wright Controls, Inc. The Court has jurisdiction to decide the Motion pursuant to 28 U.S.C. §§ 1334 and 157.
To decide the Motion, the Court must answer the following questions under North Carolina law: (i) can a “non-outsider” to a contract, as defined by the North Carolina Supreme Court, be held liable in tort for interfering with that contract; and, if so, (ii) can a “non-outsider” who uses improper…
