This matter is brought before us by a writ of error, through the instrumentality of which the plaintiffs in error seek to review an order or judgment of the Supreme Court, dismissing an appeal taken by the plaintiffs in error, from an order of the Special Term. Said order at Special Term was made in a proceeding instituted by the mayor, aldermen and commonalty of the city of New York, under chapter 86 of the Revised Laws of 1813, for the purpose of ascertaining the compensation to be made to the owners of a certain piece or parcel of land, required for the purpose of opening…
