CROSKEY, J.

Plaintiff Richard Lubetzky appeals from a February 13, 1987, order denying in part his motion to tax costs on appeal. For the reasons discussed below, we modify the order and affirm it as modified.

Procedural Background

Plaintiff filed a complaint on July 10, 1984, and on January 22, 1985, he filed a first amended complaint against the following named defendants: Robert Friedman, Erving Friedman, Monica Friedman, Ariel Ganezer, Charles J.
