On January 8, 1992, respondent Fairview Hospital and Health Care Services (Fair-view) commenced a declaratory action in Hennepin County District Court against appellant St. Paul Fire & Marine Insurance Company (St. Paul) seeking a ruling of entitlement to indemnification under insurance policies issued by St. Paul. Fairview sought coverage for costs incurred as a result of its liability for environmental contamination at two landfills located in Anoka County: the East Bethel Sanitary Landfill and the Oak Grove Sanitary Landfill.
