AREND, Justice.

This is an action by the plaintiff, who is -the appellant here, to recover damages for ■personal injuries received when he was assaulted by one Williamson, an employee ■of the defendant, Rose Shelley. Williamson was named in the complaint as a party ■ defendant. He did not appear at the trial of the case, though he was represented by the same counsel who represented the defendant, Rose Shelley.
