This is an action to recover damages for the destruction of a quantity of saw logs and standing timber upon lands of the plaintiff by two separate fires which are alleged to have been set by the negligent escape of sparks from the smokestack of defendant’s sawmill located upon adjoining lands. Upon a former appeal in this action a demurrer to a counterclaim set forth in the answer was sustained. See Rylander v. Laursen 113 Wis. 461, 89 N.
