Sue E. McNeill, a resident of Laurel county, Ky., died on April 22, 1934, the owner of considerable property, both real and personal. She, and an unmarried sister, the appellant Elizabeth McNeill, and an unmarried brother resided together. The decedent was never married and left no surviving relatives in the ascending line, her only heirs being collaterals.
