MEMORANDUM AND ORDER
ROGERS, District Judge.
This case is now before the court upon plaintiffs motion for preliminary injunction, defendant’s motion to dismiss and plaintiffs motion to combine the hearing upon the preliminary injunction motion with the trial on the merits.
BACKGROUND
Plaintiff is a nonprofit Kansas corporation exempt from federal income tax.
