This action was instituted on September 18, 1934, by the defendants in error, hereafter referred to as plaintiffs, against plaintiff in error, hereafter referred to as defendant, to recover an alleged balance due on the purchase price of certain lands and to establish a vendor’s lien thereon and for other relief. Trial was had, and at the close of plaintiffs’ evidence a demurrer thereto was sustained, and the plaintiffs appealed said action here. This court reversed and remanded the cause for a new trial.
