This is a suit in equity brought by Maude Bragg, widow of C. E. Bragg, deceased, against Charles G. Ross, Mary Tip-ton Ross, his wife, and certain other defendants. One of the remaining defendants is sued merely as the trustee in a deed of trust. The others, beside the Rosses, have defaulted. The Rosses filed a demurrer to the plaintiff’s petition which was sustained by the trial court and she appealed to this court. The case was assigned to Division Two, which held the petition sufficient [Bragg v. Ross, 139 S. W. (2d) 491], and therefore reversed and remanded the cause. It was thereafter…
