MEMORANDUM AND ORDER
MAGNUSON, District Judge.
INTRODUCTION
This matter is before the court on plaintiffs motion for summary judgment and defendant Westridge’s cross motion for partial summary judgment. For the following reasons, plaintiffs motion is granted and defendants’ motion for partial summary judgment is denied.
BACKGROUND
