MEMORANDUM ORDER
COPENHAVER, District Judge.
This matter is before the court on the motion of the defendants for summary judgment.
I. Background
Plaintiff Kenneth Ray Thacker was employed by the Water Board of the City of Hurricane, West Virginia, from approximately January 1977 until April 10, 1989. On April 20, 1989, he was discharged by defendant R. Douglas Peak (hereinafter, Doug Peak) when he appeared for work at a time when he was scheduled to be on vacation.
