TATEL, Circuit Judge:
The National Labor Relations Board found that petitioner committed an unfair labor practice by bringing a RICO suit against unions that opposed construction and other permits sought by non-union contractors. The Board ordered petitioner to pay the legal fees the unions incurred in defending the suit. Because we agree with the Board that the unions’ activities were protected by the National Labor Relations Act, and because the Board’s finding that petitioner’s lawsuit was both un-meritorious and retaliatory is supported by…
